These Terms and Conditions govern the use of this website and the booking and delivery of services provided by Hearthway. Please read them before making an enquiry or booking. By using this website or booking a service, you indicate that you have read and accepted these terms.

1. Definitions

"Hearthway", "we", "us", "our" — the business trading as Hearthway, based at 18/2 Huay Kaew Road, Su Thep, Mueang Chiang Mai, Chiang Mai 50200, Thailand.
"Service" / "Sessions" — the educational workshops, facilitation meetings, and records support services offered by Hearthway.
"User" / "you" — any individual visiting this website or booking a service from Hearthway.
"Participant" — any person attending a session, whether or not they made the original booking.
"Agreement" — these Terms and Conditions together with any booking confirmation issued by Hearthway.

2. Acceptance of Terms

By using this website or confirming a booking, you agree to be bound by these Terms. You must be at least 18 years of age to make a booking on behalf of yourself or others. If you are booking on behalf of a family group, you confirm that all participants aged 18 or over have consented to attend.

3. Nature of Services

Hearthway provides the following non-regulated, publicly available services:

Conversation Skills Sessions: group educational workshops on communication within family settings (฿3,600 per session)
Neutral Facilitation Meetings: voluntary, impartial facilitation of family discussions (฿10,500 per meeting)
Shared Notes & Records Support: assistance organising agreed points into written notes (฿26,500 per document)

Hearthway does not provide legal advice, counselling, representation, or any service requiring a professional operating licence. No Hearthway service should be interpreted as a substitute for independent professional advice. Nothing produced by Hearthway constitutes a legally binding instrument unless separately formalised through appropriate legal channels.

4. Booking and Confirmation

A booking is confirmed when Hearthway sends a written confirmation to the email address provided. Hearthway reserves the right to decline a booking at its discretion, in which case no fee will be charged. Session dates and times may be rescheduled by either party with reasonable notice, subject to availability.

5. Voluntary Participation

All Hearthway sessions are entirely voluntary. Any participant may withdraw at any time before or during a session without penalty. Hearthway will not contact any participant to encourage continued attendance against their wishes. The voluntary nature of participation is a fundamental feature of all services and cannot be waived.

6. User Responsibilities

When using our website or attending sessions, you agree to:

Provide accurate contact information in any enquiry or booking form
Attend or give reasonable notice if you are unable to attend a scheduled session
Engage with sessions in good faith and with respect for other participants
Not record sessions (audio, video, or otherwise) without written consent from Hearthway and all other participants
Use this website only for lawful purposes

7. Cancellation and Rescheduling

If you need to cancel or reschedule a session, please notify us at least 48 hours in advance. Cancellations with less than 48 hours' notice may result in a cancellation fee of up to 50% of the session fee. Cancellations made more than 48 hours in advance will receive a full refund or rescheduling at no additional charge. Hearthway will not charge for cancellations made within 24 hours of booking.

8. Payment

Session fees are quoted and payable in Thai Baht (THB). Payment terms will be communicated at the time of booking confirmation. Hearthway reserves the right to decline to proceed with a session where payment has not been received according to agreed terms.

9. Intellectual Property

All content on this website — including text, layout, and educational materials — is the property of Hearthway or its content suppliers and is protected under applicable intellectual property laws. You may not reproduce, distribute, or adapt any content without our prior written consent. The Conversation Kit distributed in workshops is for the personal, non-commercial use of participating families only.

10. Confidentiality

Hearthway commits to treating all session content as confidential and will not disclose what is discussed in sessions to any third party except where required by law. Documents produced under the Shared Notes service are provided solely to the commissioning family and not retained by Hearthway after handover. Participants are encouraged to respect the confidentiality of other participants in shared sessions.

11. Disclaimers

Hearthway's services are provided for general educational and facilitation purposes. We make no representations about outcomes, and no session result is implied or guaranteed. Nothing on this website or provided in sessions constitutes professional advice of any kind. Where families require legal, financial, or clinical assistance, they should seek independent qualified professionals.

12. Limitation of Liability

To the extent permitted by Thai law, Hearthway's liability in relation to any service or use of this website is limited to the fee paid for the relevant service. We are not liable for indirect, consequential, or incidental losses arising from the use of our services or reliance on our content.

13. Indemnification

You agree to indemnify Hearthway against any claims, losses, or expenses arising from your breach of these Terms, your use of this website, or your conduct in sessions.

14. Governing Law and Disputes

These Terms are governed by the laws of Thailand. Any dispute arising from these Terms or any service provided by Hearthway will first be subject to an informal resolution process. If not resolved informally within 30 days, disputes may be referred to the competent courts of Chiang Mai Province, Thailand.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted by a revised effective date. Continued use of this website after changes are published constitutes acceptance.
